In consideration of the Waiver and Release that we have been asked to sign regarding the kitchen tiling/repairs,  the answer is we will not sign the waiver.
 
The fact that you are asking us to give up all warranty rights in this matter is unacceptable.  Who is to say that the walls won't twist/bend in the future and this problem won't come back.  The warranty is an integral part of the purchase of a new home and we feel that no rights should be given up.
 
In conversations with the service department, I understood that that we could pick any tile up to level 4.  After doing so, Pratt came back to us and said they could not do the band that had been selected due to cost.  The tile style was changed to one that was acceptable with the understanding that the wall would be tiled from floor to under the upper cabinets.  Now in this waiver, the tile behind the stove and fridge only goes from the counter top to the bottom of the upper cabinets.
 
It seems every time something seems to be agreed on, it gets changed.   
 
The question was brought up by Wendy, while delivering the waiver on Nov. 8th,  that it might take two days to replace the front of the counter, depending if the contractor had to take the counter top off.  This would mean they would be in the way of the contractor doing the tiling.  Pratt was to check if it would take two days or not.  As of today, Nov. 9th, we have not been advised if it will take two days or not.  I have arranged to be here on Nov. 16th when itis supposed to be done, but if it takes more time where I have to be around the unit, I need to know.
 
In lieu of what has happened with everything and now the waiver,  we will sending these issues on to Tarion Warranty Corporation in their required time frame.  The issue of the front of the peninsula was part of our original purchase agreement, and to this date it still hasn't been fixed.
 
In light of these developements,  please advise if the date of Nov. 16, 2010 for fixing these issues  is still valid.
